GTC
§ 1. subject of contract
Phono-Vertriebs GmbH sells the goods specified in the online store to customers under the following terms and conditions of delivery and sale (GTC’s).
§ 2nd conclusion of contract
The contract between the customer and the Phono-Vertriebs GmbH is only concluded by an order of the customer and its acceptance by the Phono-Vertriebs GmbH. The customer’s order is placed via the Internet shop.
The Phono-Vertriebs GmbH accepts the order by (a) sending the customer an order confirmation or (b) delivering the ordered goods (incl. invoice).
§ 3. products
Sämtliche data to the goods, which the customer receives in the context of the order process, are noncommittal. In particular, we reserve the right to make changes in design and technology that do not alter the functionality of a product, as well as errors in description, illustration and pricing.
Only brand new products in original brand quality will be delivered.
§ 4th offer, delivery
Our offer is valid for private as well as commercial business traffic and while stocks last. It is always non-binding and subject to confirmation. We reserve the right to prior sale and price changes before conclusion of the contract. Phono-Vertriebs GmbH delivers to end customers in Switzerland postage paid. For all other customers, the individual delivery agreement applies.
Additional costs for other modes of transport requested by the customer shall be borne by the customer. The risk shall pass to the customer as soon as the goods have left our premises, but at the latest when they have been handed over to a carrier. In the event of externally visible damage to the ordered goods, settlement of damages will only be made against a certificate from the respective carrier. Obvious defects must be reported immediately in writing, but at the latest within 3 days of receipt of the goods and returned within 5 days, otherwise the goods are deemed to have been approved. Liability of the costs for damage caused directly or indirectly by the delivered goods (consequential damage) is rejected.
§ 5 Retention of title
We retain title to all goods delivered to the customer until we have received all payments owed on the basis of the business relationship.
§ 6. prices and terms of payment
- All prices published in our price list are net prices in Swiss francs including the legal value added tax of 7.7%.
- Our prices are subject to change without notice and are valid as long as stocks last.
- All prices include packaging and transport by parcel post or truck within Switzerland. Delivery costs will be charged for deliveries abroad.
- Claims resulting from deliveries made by us are payable:
- On receipt of invoice within 30 days after receipt of invoice net without discount
- by means of the offered payment options via credit or postcard
- cash on delivery, whereby additional CHF 25.- cash on delivery fees will be charged
- against prepayment
- first orders over CHF 100.00 will only be executed against advance payment.
Phono-Vertrieb is entitled at any time to deliver only against cash in advance or cash on delivery.
In the event of late payment, we are entitled to charge reminder fees in the amount of CHF 10.- as well as interest on arrears.
§ 7. deliveries abroad
Orders from abroad are very welcome.
These are exclusively against prepayment via Paypal. As soon as the invoice amount has arrived, the goods will be sent by A-Post. In exposed countries the delivery takes place by registered mail. Shipping rates can be found in the delivery and shipping costs.
§ 8. warranty
In principle, we pass on the manufacturer’s warranty in full to our customers. Unless otherwise agreed, the warranty will be compensated by replacement. Excluded from the guarantee are damages due to improper handling, force majeure or natural wear and tear. Freight, shipping and insurance costs shall be borne by the customer.
§ 9. right of release
In principle, there is no Rückgaberecht. However, in exceptional cases and after consultation with Phono-Vertriebs GmbH, such a right may be agreed. If a right of sale is granted, this shall apply exclusively to products in their original packaging and cellophaned for copyright reasons.
§ 10. place of performance, place of jurisdiction
Place of performance and jurisdiction for both parts is Stans NW.
